Bookings & Deposits

• Private Party and other bookings may require a deposit or payment at checkout.
• Deposit and cancellation rules displayed and accepted at checkout for that booking control.
• Prices, availability, and booking terms for a new reservation are those disclosed at the time of that new booking.

Cancellations (Customer-Requested)

• Customer-requested cancellations are governed by the cancellation terms accepted for the original booking.
• Canceled deposits do not automatically convert into account credits, gift cards, or cash refunds unless a specific booking’s accepted terms say otherwise, or applicable law requires otherwise.
• Company/operator cancellations are handled under the company-cancellation policy disclosed for that booking (do not mix that workflow with discretionary courtesy credits below).

Courtesy Booking Credits

Customer-requested cancellations remain governed by the cancellation terms accepted for the original booking. Canceled deposits do not automatically convert into account credits.

Blue Shore Pedal Lounge LLC may separately grant a complimentary benefit under its customer-retention program. A grant requires no additional payment and is not available for purchase or cash loading.

Each grant identifies the recipient, amount, eligible services, and expiration (book-by) date. Unless the grant states otherwise, it is personal to the named recipient, nontransferable, and automatically applied to eligible booking charges at checkout. Partial use leaves the unused portion available until the stated deadline. No fees apply.

The benefit must be applied to a confirmed booking by its stated deadline; the scheduled ride may occur afterward, subject to availability. Current prices and the new booking’s disclosed terms apply.

The benefit is not redeemable for cash except where required by law. These terms do not limit amounts payable under the original company-cancellation policy or rights that applicable law does not permit us to waive.

• When issued, confirmations and your account may identify the benefit as a “Courtesy booking credit — Promotional benefit.”
• Credits are discretionary goodwill grants, not a promise that every cancellation creates a credit.
• If someone else paid (payer) and a different person (guest/organizer) will receive the credit, Blue Shore may require the payer’s authorization before issuing the credit to that recipient. Private reimbursement between payer and guest is their responsibility.
• Courtesy booking credits are individually issued retention benefits. They are not a public deposit wallet, are not automatically created by cancellation, and are not sold as gift cards on this site unless a separate gift-card product expressly says so.

Payments, Chargebacks & Third-Party Processors

• Payments may be processed by Square or other processors under their terms.
• A restrictive refund/cancellation policy does not prevent a cardholder from filing a chargeback; Blue Shore may respond with booking, policy-acceptance, and cancellation records.

Liability Waiver; Assumption of Risk

Every adult rider must sign Blue Shore Pedal Lounge LLC’s separate Waiver and Release of Liability Agreement before boarding. A rider who has not signed will not be permitted to participate. If you book for others, you must ensure every rider in your party signs before boarding and that you have informed them of the Waiver’s terms.

The Waiver (not this webpage alone) is the primary agreement governing personal injury, death, property damage, assumption of risk, release, indemnity, rider conduct on the Activity, alcohol rules during the Activity, media capture during participation, and dispute resolution for claims arising out of the Activity. These Terms govern website use, bookings, deposits, cancellations, payments, and courtesy booking credits. If there is a conflict about Activity liability or Activity dispute resolution, the signed Waiver controls to the fullest extent permitted by law.

Key points summarized for convenience (the signed Waiver controls if wording differs):

• You assume significant risks of a pedal trolley tour, including no seat belts, traffic, weather, other riders, and alcohol-related impairment.
• You release the company and related parties from claims for ordinary negligence to the extent allowed by Texas law (gross negligence / intentional misconduct are not released).
• You may have indemnity obligations for your conduct and guests in your care.
• Private tours are BYOB; the company does not sell alcohol. On public pickup service, complimentary adult beverages (if offered) are only for riders 21+ with valid ID; fares are for trolley time/services, not for alcohol.
• Staff may refuse boarding or remove a rider for intoxication or rule violations without refund.
• Unauthorized abandonment of the vehicle during a tour may result in a $250 charge as described in the Waiver.
• Maximum rider weight is 275 pounds.
• The company does not provide helmets.
• Minors under 18 may participate only with a parent/legal guardian signature on the Waiver; no one under 21 may consume alcohol.
• The Waiver includes binding arbitration in Nueces County, Texas, and waivers of jury trial and class actions, with a small-claims exception, as stated in the Waiver.

Alcohol, Conduct & Safety

Additional experience rules shown at booking, on-experience, or in the Waiver apply. Riders must follow staff/captain instructions. Unsafe, illegal, harassing, or highly disruptive conduct may result in denial of boarding or removal without refund to the removed rider. You are responsible for documented damage to company equipment caused by you or your guests beyond normal wear.

Limitation of Liability (Website & Booking)

For claims arising from use of this website, booking, payment, or courtesy booking credits — and only to the extent not governed by the Waiver — Blue Shore Pedal Lounge LLC provides the website on an “as is” basis. To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages. Our total liability for such website/booking claims will not exceed the amounts you paid to us for the booking giving rise to the claim, except where prohibited by law.

Nothing in these Terms limits liability that cannot be limited under applicable law, and nothing here reduces protections or obligations in a signed Waiver for the Activity.

Governing Law; Disputes

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules.

• Disputes arising out of or relating to the Activity or the Waiver are resolved as stated in the Waiver (including binding arbitration in Nueces County, Texas, jury/class waivers, and the small-claims option).
• Disputes arising solely out of these website Terms (for example, booking/payment/credit disputes not covered by the Waiver) shall be brought in the state or federal courts located in Nueces County, Texas, unless the parties agree to arbitrate.

Changes to These Terms

We may update these Terms by posting a new version on this page with an updated “Last updated” date. Material changes to booking products may also be disclosed at checkout.
